The pandemic also forced changes in many paradigms of providing healthcare services. One of them, con-tained in the so-called ‘Special Covid Act’, was to simplify the acquisition of right to practise as a&nbsp;doctor by a&nbsp;foreigner who is not a&nbsp;citizen of a&nbsp;European Union Member State. The study focuses on one of the facilitations introduced: relinquishment of the four-stage examination on knowledge of the Polish language in favor of submitting a&nbsp;statement on the command of the Polish in speech and writing to the extent neces-sary to practise as a&nbsp;doctor, i.e. resignation from an objective, verifiable assessment, in favor of a&nbsp;civil law declaration will, in principle not verifiable at the time of sub-mission. This solution raises a&nbsp;number of doubts and carries the risk of a&nbsp;medical error. First and foremost, a&nbsp;medical interview, one of the key and initial stages of treatment initiation, becomes impossible to conduct. Secondly, it is also difficult to communicate with other medical personnel. Thirdly, it is doubtful whether another statutory obligation will be fulfilled, namely providing information to the patient about their state of health and obtaining consent for treatment. The mechanism of supervision by another doctor who speaks Polish should also be considered insuf-ficient, as due to the lack of such personnel, it will often be impossible to meet this condition. These and other reasons support a&nbsp;negative assessment of the solutions introduced. A&nbsp;much better solution would be to provide intensive learning of the Polish language, a&nbsp;solution that is proven and used successfully. Referring to the language of the EU directives on the recognition of professional qualifications, it is a&nbsp;“reasonable and necessary” direction.</p> 2022-06-10T07:32:40+00:00 Copyright (c) 2022 Sławomir Pawłowski Ustanowienie świętego patrona miast, gmin, powiatów i województw 2022-06-10T12:10:24+00:00 Krzysztof Świderski <p>The subject of this article is the procedure for selecting a&nbsp;saint of the Roman Catholic Church patron saint for the city, municipality or wider territory. The establishment of a&nbsp;patron saint is within the competence of the confessional authority, in particular, the bishop and the Congregation for Divine Worship and the Discipline of the Sac-raments. The procedure consists of three stages: the election, acknowledgement and affirmation of the patron saint. The church’s current regulations regarding the election of patron saints are contained in two documents of the Holy See. The municipal council, the poviat council and the assembly of the province pass a&nbsp;res-olution on the patron at the stage of his election by the society and the clergy. The above-mentioned authorities do not take part in the next two stages. Entities of territorial self-government only have a&nbsp;supporting vote. They cannot independently establish a&nbsp;patron saint, regardless of the decisions of the ecclesiastical authorities. The position of administrative courts that the resolutions of the constitutive au-thorities of entities of territorial self-government belong to the category of public administration matters is unjustified. The decree of the Congregation for Divine Worship and the Discipline of the Sacraments is addressed to a&nbsp;given diocese and not to local self-government authorities. The patron saint is established for a&nbsp;city, mu-nicipality, poviat, or for an area that does not have administrative borders. Entities of territorial self-government must respect the autonomy of the church authorities, and public authorities should be impartial in religious matters. Therefore, entities of territorial self-government do not have the competence to establish a&nbsp;patron saint for the promotion of a&nbsp;municipality, district or self-government of the voivodship. However, they can refer to saint persons at the symbolic level, for example, in the coat of arms or the names of streets and squares. This also applies to schools and hospitals run by local self-government authorities.</p> 2022-06-10T07:56:08+00:00 Copyright (c) 2022 Krzysztof Świderski Przerywanie ciąży – rozważania w świetle orzeczenia Trybunału Konstytucyjnego w sprawie K 1/20 2022-06-10T12:10:22+00:00 Piotr Szudejko <p>The article presents the issues of legal regulation of termination of pregnancy in the context of the jurisprudence of the Constitutional Court (CC), in particular the ruling in the case K 1/20.<br>The discussion opens with an analysis of models of abortion practices regulations, as well as the solutions adopted in the Polish legal system, with a&nbsp;short historical introduction. It is emphasized how important is the issue, which results from the fundamental differences in worldviews between the supporters and opponents of the permissibility of the practice of termination of pregnancy, which is expressed in the name given to this medical practice.<br>The right to life as an element of the human rights system is discussed, both in terms of international law and the provisions of the Polish constitution.<br>Next, the Polish provisions on the admissibility of termination of pregnancy are presented along with a&nbsp;historical outline, with particular emphasis on the ruling in the case K 26/96. Based on the above discussion, the resolution in the case K 1/20 was discussed, in which the CC found the so-called embryopathological premise for termination of pregnancy to be incompatible with Polish Constitution. A&nbsp;polemic with the justification of the decision is presented, including the errors of interpreta-tion committed by the CC&nbsp;with regard to the constitutional and international form of the right to the protection of life. It is indicated that in the Polish legal system only the right to protection of life exists, not the right to life, which is referred to both by the CC and most of the doctrine.<br>Despite the fact that this resolution does not remove the norm from the legal system, the author draws attention to the practical consequences of issuing it, in particular the occurrence of the so-called ‘chilling effect’ and unjustified activity of the law enforcement authorities.<br>The final part of the article presents conclusions on how to legally regulate the termination of pregnancy.</p> 2022-06-10T09:24:36+00:00 Copyright (c) 2022 Piotr Szudejko Uzdrowiskowe władztwo zakładowe oraz jego wpływ na prawa i obowiązki pacjentów zakładu lecznictwa uzdrowiskowego 2022-06-10T12:10:38+00:00 Paulina Jachimowicz-Jankowska <p>The article presents the institution of corporate governance in spa treatment entities that conduct organized activities in the field of providing spa health care services and spa rehabilitation. Using the term health resort management adopted for the purposes of this study, attention is drawn to the general administrative powers of the health resort authorities towards users (patients). There is no doubt that this sovereignty is necessary to achieve the objectives of a given entity. In the case presented here, the goal of the health resort treatment facility is to conduct spa treatment and to provide patients with guaranteed health services in this area. This study confirms that the acts of corporate law include organizational regulations and the statute of the health resort in the health resort. Against their background, reference is made to the problem of compliance with the corporate governance guaranteed by authoritative legal measures. The aim of the study is to analyze and evaluate the legal regulations concerning the authority used in the spa treatment facility. In this matter, the concept and essence of the institution of corporate governance on the grounds of doctrine and jurisprudence are discussed, and a&nbsp;catalog of features typical of spa company governance is indicated. The institution of the company regulations and statutes of the spa treatment facility is also examined, indicating the characteristics and legal nature of the standards established by company bodies, in terms of both the legal forms of operation of the facility and the sources of law. The issues of users and the use of a&nbsp;spa treatment facility allow for the indication of the rights and obligations of users of this type of facility, along with showing doubts regarding the issue of paying fees for health services in the field of spa treatment or spa rehabilitation.</p> 2022-06-10T00:00:00+00:00 Copyright (c) 2022 Paulina Jachimowicz-Jankowska Historia powstania regionalnych trybunałów praw człowieka 2022-06-10T12:10:31+00:00 Anna Dąbrowska <p>The history of the formation of regional human rights courts, parts of human rights regimes on the European, African and both the American continents, is discussed in this paper. The author demonstrates an unquestionable connection between the courts and international government organisations active in the regions. She proves that the main reasons for establishing these authorities lie in the develop-ment of human rights protection systems and the associated need for supervision by independent judicial authorities, since the guarantee of rights and freedoms under regional treaties proved insufficient. The analysis shows the human rights courts were founded at different times and in diverse realities. The European Court was formed to supervise the democratic states in the region, whereas the non-European courts both were and still are regarded as unstable and implicated in internal conflicts. The next part of this article includes a&nbsp;discussion of the legal basis for estab-lishing regional human rights tribunals. All three bodies were established on the basis of a&nbsp;classical source of international law, namely an international treaty. The fundamental difference, however, is that with regard to the European and American Courts, these are treaties that form the basis of regional systems of human rights protection, while the African Tribunal was created under the Additional Protocol to the African Charter on Human and Peoples’ Rights.</p> 2022-06-10T00:00:00+00:00 Copyright (c) 2022 Anna Dąbrowska Immunitet jurysdykcyjny Stolicy Apostolskiej a odpowiedzialność za nadużycia seksualne duchowieństwa. Belgia (Skarga nr 11625/17) 2022-06-10T12:10:28+00:00 Paweł Borecki <p>The Belgian courts and the ECtHR treating the Holy See as a&nbsp;state is an over-inter-pretation. The Holy See cannot be treated as a&nbsp;foreign sovereign. This is a&nbsp;historical anachronism. At the very most, we can speak of the so-called ‘spiritual sovereignty’ of the Holy See, which his related to the fact that it is the governing body of the Catholic Church. However, it has no public-law powers over church structures and its followers. The Church is a&nbsp;voluntary international private association of natural persons. It has no administrative power over its members. The Holy See has a&nbsp;superior position over bishops. Therefore, it should also be responsible for the lack of a&nbsp;proper reaction by these church leaders to the sexual abuse of the clergy subordinate to them. In the past, the Catholic Church operated a&nbsp;policy of silence (omerta) based on clericalism. The pontificate of Pope Francis brought about fun-damental changes in this area. However, the judgment of the European Court of Human Rights of October 12, 2021 is procrastinating and will probably trigger what can be termed a&nbsp;‘chilling effect’. II SA/Ke 1068/20, the Provincial Adminis- trative Court in Kielce held that a request submitted by a councillor under Article 24(2) of the Act on Municipal Self-Government for access to information and materi- als cannot be treated as a request for access to public information, and that a refusal or failure to act in this respect is not subject to an administrative court review. It is impossible to agree with this position. The information and materials referred to in Art. 24 Clause 2 of the Act on Municipal Self-Government may constitute public information, although this is not necessarily the case. This is clearly supported by their subject matter. Failure to make information and materials available to a coun- cillor under Art. 24 Clause 2 of the Act on Municipal Self-Government may then be subject to judicial review. If the subject matter is public information, inaction&nbsp;&nbsp; in this respect may be challenged by filing a complaint for inaction, as provided for in Art. 3 § 2 Item 8 of the Administrative Court Proceedings Act. The view was shared that the period for lodging an appeal begins on the day on which the administrative decision is served upon the party (com- municated orally to the party) and it is at this moment that the period commences, although the day on which an administrative decision is served is not counted when calculating this time limit. Therefore, on the very day on which an adminis- trative decision is served, the party may submit an appeal against it, an application to reconsider the matter or waive the right of appeal. An appeal, an application&nbsp;&nbsp;&nbsp; to reconsider the matter or a statement on waiving the right of appeal are legally effective, because they are submitted during period for the filing an appeal. not content of Art. 57 (1) of The Code of Administrative Proceedings, which regulates the way of calculating the time limit in days.
