Abstrakt
Celem artykułu jest ukazanie problemu konstytucjonalizacji Unii Europejskiej, zarówno w perspektywie historycznej, ale również biorąc pod uwagę argumenty prawne i polityczne pojawiające się w debacie na ten temat. Idea przyjęcia konstytucji europejskiej pojawiła się już nawet w wieku XIX, ale dopiero w wieku XX zyskała na znaczeniu, gdyż opowiadały się za jej przyjęciem organizacje federalistyczne. W 2004 r. został podpisany w ramach Unii Europejskiej Traktat ustanawiający Konstytucję dla Europy, który jednak nie wszedł w życie z uwagi na negatywne wyniki referendów ratyfikacyjnych we Francji i Holandii. Oprócz analizy historycznej w artykule przedstawia się argumenty, dlaczego w ramach Unii Europejskiej trudno jest przyjąć konstytucję. Przede wszystkim zwraca się uwagę na argument o braku europejskiego demos. Pokazując różne punkty widzenia dotyczące konstytucjonalizacji UE, w artykule wskazuje się również na orzeczenia Europejskiego Trybunału Sprawiedliwości, który określił obowiązujące traktaty założycielskie mianem karty konstytucyjnej.
