Abstrakt

The article addresses the inactivity of a public administration authority where a single normative process comprises separate administrative cases considered by different authorities on the basis of distinct substantive-law competences, while the cases remain normatively interdependent. The study objective is to determine the limits of judicial review by administrative courts when, after a complaint against inactivity has been lodged in one case, a decision is issued in another, normatively linked administrative case. The analysis asks whether that later decision may remove the legal consequences of the earlier omission and make judicial determination of the authority’s duty to act devoid of purpose. The study applies the dogmatic legal method, reconstructing substantive and procedural norms and examining the relationship between administrative competences and the remedies provided for in Article 149 of the Law on Proceedings before Administrative Courts. The recruitment procedure for a military university and the subsequent procedure concerning appointment to military service serve as the principal example. The analysis shows that these procedures constitute separate administrative cases, even though the outcome of the first determines whether the next stage may lawfully proceed. A decision in the appointment case therefore neither cures inactivity in the recruitment case nor deprives the complaint against inactivity of its subject matter. Effective judicial review in such a configuration requires not merely a declaration that inactivity occurred but, where performance remains legally possible, an order requiring the competent authority to discharge the obligation arising from the applicable competence-conferring norm.
