Abstrakt
Rozporządzenie UE 2023/1115 (EUDR) zawiera wymóg, że towary takie jak bydło, olej palmowy, soja, drewno, kakao, kauczuk, kawa i produkty z nich wytwarzane muszą pochodzić z obszarów wolnych od wylesiania, aby mogły być dopuszczone do obrotu w Unii Europejskiej. Biorąc pod uwagę, że Brazylia jest największym na świecie producentem kawy, EUDR będzie mieć na nią prawdopodobnie najbardziej dotkliwy wpływ. Autorzy artykułu badają jego konsekwencje dla upraw kawy w Brazylii, porównując kontrowersyjne kwestie, które pojawiły się w tym sektorze. Ostatecznie stwierdzają, że główne kwestie prawne związane z EUDR i brazylijskim sektorem kawy obejmują koncepcję lasu, rolę spółdzielni w odniesieniu do definicji podmiotów gospodarczych i handlowców, zróżnicowany system należytej staranności dla małych i średnich przedsiębiorstw oraz kryteria ryzyka dla produkcji kawy.
