Abstrakt
Przedmiotem niniejszego artykułu jest zagadnienie niewypłacalności gmin. Przypadki zapaści finansowej gmin są zjawiskami materializującymi się w praktyce. Niektóre systemy prawne przewidują zatem specjalną regulację na taką okoliczność, podobną do regulacji dla przedsiębiorców. W artykule szczególną uwagę poświęcono prawodawstwu federalnemu w USA w zakresie niewypłacalności municypalnej. Wskazano na oczekiwania co do reformy tamtych przepisów oraz na uregulowania w tej materii w innych systemach prawnych. Autor argumentuje, że potrzebne jest wprowadzenie specjalistycznej regulacji także w prawie polskim, a także przedstawia założenia do odpowiednich zmian.
