Abstract
The article presents the competences of the European Committee of Social Rights in monitoring States’ compliance with the European Social Charter. The Council of Europe’s treaty acquis in the field of the protection of human rights and fundamental freedoms is rich and extensive, and the system of monitoring States’ compliance which it has established may be regarded as a reference model for other international organisations. The system of supervising compliance within the European Social Charter is analysed with an emphasis on its main institution – the European Committee of Social Rights – considered to be a particular treaty body. While ruling on the conformity of the situation in States with the European Social Charter, the Committee employs both the classical instruments of control, that is national reports submitted by States, as well as specific instruments of control, that is collective complaints. In reviewing collective complaints, the European Committee of Social Rights undertakes actions which justify the stance of the Committee being equipped with quasi-judicial competences.
