Abstrakt
Przedmiotem niniejszej analizy historyczno-prawnej jest badanie zjawiska przymusowej sterylizacji w Kalifornii w latach 1909–1979, czyli w okresie wdrażania polityki eugenicznej, która miała na celu poprawę składu genetycznego populacji. Poprzez szczegółową analizę ram prawnych, kluczowych spraw sądowych oraz kontekstu społeczno-politycznego, badanie ukazuje w jaki sposób ideologia eugeniczna zyskała akceptację, co w rezultacie doprowadziło do sterylizacji tysięcy osób pod pozorem doskonalenia społecznego. Analiza zagłębia się w etyczny, prawny oraz historyczny wymiar tych praktyk i podkreśla rolę Kalifornii jako centralnego punktu w dyskusji na temat eugeniki i praw człowieka na poziomie krajowym i międzynarodowym. Stopniowe odrzucenie ideologii eugenicznej oraz zwrot w kierunku uznawania ofiar i wypłacania im zadośćuczynienia odzwierciedlają obecną krytyczną ocenę dawnych niesprawiedliwości, a także podkreślają znaczenie kwestii etycznych w praktyce medycznej i prawnej.
